Drugged Driving Caused By Prescription Medications

Drugged Driving Caused By Prescription Medications

Dallas, 07/26/2016 /SubmitPressRelease123/

Most people associate impaired driving with alcohol. Police in most states also concentrate the bulk of their efforts to reduce impaired driving by focusing on drunk drivers. They use sobriety checkpoints and roadside breathalyzer tests to determine if a motorist has had too much to drink to drive safely.

Drunk driving is definitely a leading cause of car accidents, but impaired driving laws also make it a crime to drive a vehicle under the influence of drugs – both illegal and legal. An individual who drives under the influence of street drugs is responsible for any injuries he or she causes at the time of the accident. Similarly, if a prescription drug or over-the-counter medication makes a person too impaired to drive, he or she can be cited for causing the crash. Motorists who cause injuries by driving under the influence of drugs can also be held liable in civil court for the injuries and other damages they cause.

If you have been hurt by a negligent driver, it’s important to get help from an experienced car accident lawyer. Don’t wait to speak to a lawyer about your case. Get the help and support you need today.

Driving Under the Influence of Prescription Drugs

Fortunately, drunk driving deaths have declined in recent years. Sadly, the number of fatal accidents caused by drugged drivers has gone up. According to the National Highway Traffic Safety Administration (NHTSA), drunk driving accidents have declined by one-third since 2007. However, in a 2014 survey, nearly one in four drivers tested positive for a drug that could negatively impact their ability to drive safely.

Because most research looks at alcohol consumption and driving, there aren’t as many studies that focus on prescription drug use behind the wheel. However, researchers say some drivers may simply fail to realize how dangerous it is to drive while taking a prescription drug. Although many prescription bottles contain warnings about a pill causing drowsiness or other side effects, many people don’t think twice about driving after taking medication. This is especially common in people who take medication regularly. They assume it is okay to drive since their medication is prescribed for everyday use.

Other drivers assume that because a medication is legal, it can’t be illegal to drive while taking it. These motorists usually don’t realize that impaired driving laws encompass much more than just alcohol. In the majority of cases, a motorist whose impairment is caused by a prescription medication does not set out to cause an accident. Just because a person doesn’t mean to act negligently, however, does not mean they aren’t responsible for the injuries they cause.

For law enforcement, proving a motorist was impaired by a prescription medication can be challenging. Unlike alcohol, it’s not always easy to measure the amount of a drug in a person’s system. Furthermore, the same dose of a drug can affect people differently. For example, some people can’t tolerate any kind of prescription narcotic, as it makes them nauseated and overly drowsy. For other people, prescription narcotics don’t cause any negative side effects. Also, it is not always possible to test for the presence of every type of drug in a driver’s system. For these reasons, it’s often tough to determine whether an accident was caused by prescription drug impairment.

In some cases, even over-the-counter medications have led to serious accidents. Legal medications, such as antihistamines and drugs used to treat motions sickness, can cause severe drowsiness in some people. When a motorist gets behind the wheel under the influence of a substance that impairs his or her ability to be safe on the road, people can get hurt.

Illegal Drugs Are Also a Problem

According to researchers at the University of Nebraska Medical Center, people are also mixing alcohol and illegal drugs together when they drive. In one study, about 70 percent of motorists who had alcohol in their system also tested positive for cocaine use. Nearly 55 percent of people who had alcohol in their body also tested positive for marijuana consumption.

Warning: Breathe At Your Own Risk

Warning: Breathe At Your Own Risk

Riverdale, NJ, 07/26/2016 /SubmitPressRelease123/

Unfortunately, we’re all familiar with air pollution. It’s an inescapable part of modern life. There are cars and trucks spewing fumes throughout our cities, smokestacks giving birth to black clouds over industrial parks, and monstrous machines spraying unpronounceable chemicals all over the countryside. It doesn’t matter where you live, the air you breathe is full of particles that, in the end, are poisonous to your body.

There’s Something In The Air

The signs of air pollution are easy to see in our environment. You can’t miss the big black cloud hovering over a factory. Your eyes become irritated and your throat closes when a badly tuned diesel truck rolls by, leaving you to suck down the fumes of burned oil and fuel. You can see, smell, and even taste the pollution in the air. The signs and the danger are obvious.

The World Health Organization estimates that about 7 million people die prematurely every year as a result of simply breathing polluted air. That’s one out of eight deaths globally. Air pollution has been linked to higher occurrences of health problems like heart disease, stroke, chronic obstructive pulmonary disease, lung cancer and acute lower respiratory infections in children. In fact, the WHO has listed air pollution as the largest single environmental health risk in the world.

An Invisible Intruder

While all of that might sound scary, it’s not even the worst part. The really scary part of all of this is that often indoor air pollution can be worse than what we see outdoors. Poor ventilation and air circulation systems can actually cause the buildup of toxic particles in the air we breathe as we go about our days.

You walk out of the urban smog at the end of your morning commute to work, relieved to be entering a new environment where everything seems cleaner and quieter, but you just might be better off outside. The effects are not so obvious. You can’t see it. You don’t smell anything strange. There’s no taste in your mouth. But it’s there. It’s there all day long, as you put in your 8 hours (or more), day after day, month after month. It is slowly but surely compromising your health and shortening your life.

The WHO considers indoor air pollution to be a factor in 3.8 million premature deaths each year caused by noncommunicable diseases like stroke, heart disease and lung cancer. As design goals have changed over the years, with more focus on energy efficiency, buildings have become increasingly closer to being airtight structures, which causes a buildup of toxic contaminants in the air — ultimately making the problem of indoor air pollution worse.

The Damage Is Reversible

The good news is that this is not a problem without a solution. In fact, the solution is fairly simple. Increasing ventilation and employing air filtering systems in any building will decrease levels of harmful particles in the air, and help to improve the overall health of anyone who spends any significant amount of time in that building.

A study conducted in 2011 found that people exposed to filtered air for 7 days showed 30% lower levels of C-reactive Protein, an indicator of inflammation and precursor to cardiovascular problems. Another study showed that by increasing ventilation rates and improving air quality in office environments, worker productivity is increased. Finally, a study conducted in 2015 showed that office workers scored an average of 101% higher on cognitive tests when working in an environment with higher air quality as opposed to working in a standard office environment.

Improving the quality of the air around us not only helps eliminate bad effects caused by pollution, it has beneficial effects. We actually function better when we are breathing cleaner air. Our organs, and especially our brains, work better when the air we breathe is purer.

The Solution Can Be Simple

Changing the quality of the air in your home or work environment doesn’t need to be a major project. Simply using proper filters in existing ventilation systems can make a big difference, but there are also stand-alone air purification solutions that can be used virtually anywhere if modifying central ventilation systems is not an option.

Camfil provides solutions for just about any type of environment, from making the air in your home healthier to meeting the strictest standards required by technical and medical cleanrooms. Air purifiers like the Camfil Air Purifier CITY work great in settings like offices, schools, and even medical facilities.

For larger areas or locations that require a higher level of filtration, the CamCleaner line can take on everything from welding smoke to chemical fumes, removing it all through ultra-efficient Absolute Hepa filters. CamCleaner systems are available in vertical, horizontal and portable configurations. There’s even a ceiling mountable unit. You can put one virtually anywhere to remove harmful pollutants from the air.

Changing The Air Can Change Your Life

The benefits of taking steps to improve the quality of indoor air are both numerous and well documented. You can improve your day-to-day life and the well-being of everyone around you, from family and friends to coworkers and customers.

Indoor air pollution is not a static thing.  It builds up and gets worse with time. By taking advantage of air cleaning devices and filters, you can stop the process and reverse the effects that this invisible killer has had on you.

Driving Deaths Go Up In Summer Says Philadelphia Car Accident Lawyer Rand Spear

Driving Deaths Go Up In Summer Says Philadelphia Car Accident Lawyer Rand Spear

Philadelphia, PA, USA, 07/27/2016 /SubmitPressRelease123/

We drive more in the summer but what really gets a boost is the number of traffic fatalities. The Pennsylvania Department of Transportation states the summer months account for less than 23% of vehicle crashes each year but almost 30% of all deaths in vehicle accidents. Philadelphia car accident lawyer Rand Spear talks about some of the dangers of summer driving in a podcast available on YouTube.

Why the increase in fatalities? “School’s out so essentially you have a lot more young, inexperienced drivers on the road. You really need a lot of patience this time of year. There’s going to be crowds and traffic so you need to stay calm and stay alerted to avoid drivers who are noticeably agitated,” accident attorney Spear suggests.

“A long day at the beach under the hot sun can really tire you out. Stay hydrated. Don’t use alcohol to satisfy your thirst. It only increases your dehydration so keep plenty of water on hand to stay hydrated,” Spear says, “Watch out and avoid drivers who are driving erratically.”

“There are certain days and times when more accidents occur and drivers should be more vigilant. During the weekends the accident rate goes up. More crashes occur on Thursdays and Fridays but there are more deaths on Saturdays and Sundays which may be due to alcohol use,” Spear says. He states that 49% of all alcohol-related crash deaths were due to crashes on the weekends.

“People are working during the week and then come the weekends they are drinking and unfortunately many get involved in accidents and cause fatalities. Three-quarters of alcohol-related crashes happen at night even though there are more crashes during the day.”

“Communication is very important. Always plan a safe way home before the fun begins. Before you go out know how you’re going to get home. Know whether you’re going to consume alcohol or not, whether there’s a designated driver or if you’re sleeping over,” says personal injury lawyer Spear. He suggests using a designated driver or public transportation.

Technology can help make the roads safer too. “The National Highway Traffic Safety Administration has a mobile app SaferRide. It’s got three simple buttons; either a get taxi, call a friend or see where you are,” Spear says. Using that app can be a simple way to keep yourself and others safe.

If you’re driving on the road and see another driver endangering others Spear suggests contacting police. “If you see a drunk driver on the road don’t hesitate to call local law enforcement to let them know so they can be stopped before someone gets hurt. While you’re at a party or you’re with friends if you see someone that’s drinking too much take their keys from them. Don’t let them drink and drive,” Spear suggests.

“We all need to be responsible. It’s a problem that is really very big in our society. We all need to pay attention and participate in order for this problem to go away or at least be reduced.”

If you or a family member live in Pennsylvania or New Jersey and have been injured in an accident this summer, contact Philadelphia car accident attorney Rand Spear today at 888-373-4LAW or through his website for a free consultation. You can discuss what happened, how the law may apply and your best options for obtaining compensation.

Boca Raton Car Accident Lawyer Says Vacation Driving In Florida Can Be Tragic

Boca Raton Car Accident Lawyer Says Vacation Driving In Florida Can Be Tragic

Boca Raton, FL, USA, 07/27/2016 /SubmitPressRelease123/

Millions of foreign citizens visit South Florida each year reports Boca Raton car accident lawyer Joe Osborne.  The beaches, restaurants, and nightlife make our communities a desired destination. Unfortunately, our congested roadways can be dangerous especially for those unfamiliar with traffic patterns or the timing of rush hour. Foreign citizens injured in car accidents are protected by the laws of our state both civilly and criminally. It is important for our visitors to understand their rights if they need a lawyer for a car accident with injuries, especially those that are significant.

As an example, Robert and Adrienne Hammond were born and raised in Ireland. Upon Mr. Hammond’s retirement, they traveled to South Florida for a long anticipated visit. They rented a car and planned to sightsee. However, while driving in Miami-Dade County, the Hammonds encountered a truck driver delivering tile who was late and in a hurry. An illegal attempt to pass by the truck driver resulted in a collision with the Hammonds’ vehicle. The collision was direct and came without warning. Mr. Hammond was killed and Mrs. Hammond suffered a brain injury resulting in months of hospitalization and rehabilitation at Jackson Memorial Hospital. She ultimately returned to Ireland alone, a tragic outcome says car accident lawyer Osborne.

A lawsuit was filed in Miami-Dade County on behalf of Mrs. Hammond and her husband’s estate against the driver and the trucking company for the horrific injuries they sustained. A confidential settlement was reached. Mrs. Hammond was compensated for the loss of her husband. Further, she could pay her medical bills and afford some of the day to day care she needs in Ireland for the rest of her life.

The Civil Justice System protects American citizens and foreigners if injured because of someone’s negligence. Under the law, all individuals have a duty to exercise reasonable care for the protection of others. Due to language barriers or a general unfamiliarity with civil remedies, many foreign citizens may not understand or realize their rights if they are hurt while visiting our shores. It is conceivable a visitor’s home country would not provide an avenue for recovery if injuries were sustained in a similar accident but the Unites States does. Therefore, if a foreign citizen is injured while visiting, he or she should seek help from the best car accident lawyer they can find to determine the appropriate course of action.

If you, a friend, or relative have been injured in a car accident while traveling in South Florida, contact a Boca Raton car accident lawyer at Osborne and Associates to discuss your legal rights to compensation for the pain, suffering, physical limitations, additional medical treatments and impact on your life, relationships and ability to work. We can discuss how the law may apply and the best ways to protect your legal rights and interests. Call (561) 800-4020.

Are Electric Cars A Danger To Pedestrians?

Are Electric Cars A Danger To Pedestrians?

Philadelphia, PA, USA, 07/27/2016 /SubmitPressRelease123/

Modern electric cars have grown in popularity since they first appeared on the American market in the late 1990s. Over the past few years, many motorists have turned to electric vehicles as an environmentally friendly alternative to gas-powered cars. There are 276 electric charging stations and 527 charging outlets in Pennsylvania alone, with many of them concentrated in the greater Philadelphia metro region.

Electric and hybrid cars usually cost more than their gas-driven counterparts, however, auto experts say the extra cost is quickly made up in fuel savings. According to the Bankrate website, government rebates, and tax incentives can also help defray the added expensive of owning an electric vehicle.

They certainly sound appealing, but electric cars are not without disadvantages. Safety experts say electric cars pose a threat to pedestrian safety. Because they are incredibly quiet, electric vehicles have been linked to an increase in pedestrian accidents.

If you have been injured in any kind of auto accident, you have important rights. Speak to a car accident attorney as soon as possible, as you may be entitled to compensation for your injuries.

Electric Cars and the Rise in Pedestrian Injuries

When you’re accustomed to the distinctive rev of a car’s engine when you start it up or pull away from a parking spot, getting behind the wheel of an electric car can be a bit disconcerting. These vehicles are nearly soundless, which has prompted some auto manufacturers to add simulated engine noises to their vehicles to make drivers feel more comfortable. In fact, carmakers even use the same “fake” engine sounds in the latest gas vehicles, which are more fuel-efficient and naturally quieter than models produced in years past.

In the case of electric cars, however, highway regulators began noticing a troubling trend as early as the mid-2000s. A sudden jump in pedestrian injuries and deaths prompted the government to take a closer look at electric vehicles.

In 2009, a study conducted by the National Highway Traffic Safety Administration (NHTSA) revealed that electric and hybrid cars were twice as likely to cause a pedestrian accident. A follow-up study in 2011 discovered that electric and hybrid vehicles caused 35 percent more pedestrian crashes than cars with combustion engines. The Highway Loss Data Institute examined pedestrian crashes over a seven-year period and found that electric and hybrid cars were 20 percent more likely to be involved in a pedestrian accident. Several organizations that promote the rights of the blind and vision impaired population also came forward, claiming soundless electric vehicles create a major safety hazard for people with vision loss and blindness.

With so much evidence on the table, Congress took action. Federal lawmakers passed the Pedestrian Safety Enhancement Act of 2010, which required the Department of Transportation to create new regulations for automakers with respect to “pedestrian alerts” that will warn people when an electric car is in motion. The Act requires alert noises for hybrid and electric cars moving at speeds under 18 miles per hour, which is when cars are most likely to be in an environment with a large number of pedestrians. The NHTSA has released sample sounds for the proposed alerts.

Were You Injured by a Negligent Driver?

Whether a motorist is driving a gas-powered car, an electric vehicle, or a motorcycle, they are responsible for their actions behind the wheel. If you have been injured by a negligent driver, you may be entitled to compensation for your injuries and other losses. Each case is different, but you may be eligible to receive money for:

Medical bills

Pain and suffering

Lost wages

Property damage

Certainly, drivers of electric and hybrid vehicles must be hyper vigilant when driving in areas with a heavy concentration of pedestrians. Electric and hybrid cars may be increasingly common, but they are still an emerging technology. Many people are unaccustomed to a vehicle that doesn’t make noise. If you drive an electric or hybrid vehicle, it’s important to keep your eyes on the road whenever you drive.

Dallas Business Lawyer Reveals How To Safely Use A Gentleman’s Agreement

Dallas Business Lawyer Reveals How To Safely Use A Gentleman's Agreement

Dallas, Texas, USA, 07/26/2016 /SubmitPressRelease123/

Whether by handshake or an email that says “It’s a deal,” business owners often get into legal trouble because of a gentleman’s agreement (a.k.a. gentlemen’s agreement).

What is a Gentleman’s Agreement?

A gentleman’s agreement is an agreement which is not an agreement, made between two people neither of whom are gentlemen, whereby each expects the other to be strictly bound without himself being bound at all.” – Sir Harry Vaisey

Despite Judge Vaisey’s cynical description of such an agreement, most informal deals are entered into in good faith between small business owners who want to get things done without the time and cost of retaining a qualified business lawyer to paper the deal as a legally binding contract.

Donald Trump and the Art of the Handshake Deal

If you’ve read “The Art of the Deal” by Donald Trump or “Trump-Style Negotiation” by The Trump Organization’s senior legal counsel, George H. Ross, you’ll know that Trump will often shake hands on a verbal gentlemen’s agreement with another party.

However, according to Dallas Business Lawyer Mike Young, Trump will then turn the deal over to Attorney Ross or another business lawyer to draft the contract that reflects the terms agreed to between the parties.

Words Have Different Meanings

So what’s wrong with just getting things done without a written contract in place?

Spoken words often have a different meaning to the listener than to the speaker. For example, if you’re buying a shipment of smartphones and tell the supplier that you need them a.s.a.p., you might mean delivery next week. However, the seller could interpret “as soon as possible” to be three months from now when he gets his next shipment from China.

Memories Fade

As pointed out by successful entrepreneur and author Harvey Mackay, “[p]ale ink is better than the most retentive memory.”

V-103 teams up with Dallas accident lawyer Amy Witherite from Eberstein & Witherite, LLP to tell Atlanta they have someone in their corner when involved in a truck wreck.

The “Frank Ski” show, on air since 1985, has been a long time favorite in Atlanta. Ski is lovingly referred to as “The Rainmaker of Urban Radio” and it is easy to see why. With his engaging voice, Ski has been able to captivate his listening audience and increase ratings. While not on-air he has an impressive list of hobbies and titles that keep him busy. He is a philanthropist, motivational speaker, journalist, producer and all around devoted father. His love for children extends beyond his own as he is the chairman and co-founder of the Frank Ski Kids Foundation in which he commits to investing in children through outreach and motivational programs.

Ski’s passion for connecting with the community made him a perfect match for accident lawyer Amy Witherite. Witherite is widely known for her outreach to the community and the heart she has for giving back. One of her many notable outreaches includes Eberstein Witherite’s “Making a Difference” scholarship fund, in which she awards several $1000.00 scholarships to students who are committed to making a difference in their communities and at Paul Laurence Dunbar High School.

With the expansion to Atlanta, Amy searched for individuals who have the same passion for serving others. Upon meeting with the legendary Frank Ski it became apparent that the two would continue to make a difference in the world around them while joining forces.

The future looks bright for anyone who has the pleasure of calling on Amy Witherite for representation of their truck accident needs in Atlanta. You can hear all about the difference both Amy and Ski are making in the community on V-103 The People’s Station.
