More people are killed in car crashes over the Labor Day weekend than any other holiday except Thanksgiving, according to the National Safety Council. Labor Day weekend traffic accidents account for an average of 375 deaths for the previous five years, according to a 2015 National Safety Council study, with 37.5% of the accidents alcohol related.

Spear says the sheer volume of traffic increases the chances of accidents. “Summer vacations are coming to an end. You’ve got a lot of young and unfortunately inexperienced drivers on the roadway celebrating the last holiday. A lot of people are traveling so there’s a lot of cars on the road and usually when that happens there’s going to be traffic issues,” Spear says.

“The most important piece of advice I can give everyone is to not drink and drive. Law enforcement is going to be in full force focusing their attention on impaired driving. If you drink make arrangements for a designated driver or a taxi or Uber or Lyft. Don’t get behind the wheel if you’ve consumed any alcohol at all,” Spear suggests.

He also says we can take steps to minimize the harm an accident can inflict. “Make sure you wear your seatbelt. A lot of people have survived collisions because of seatbelts. Safety belts save lives,” auto accident attorney Spear says.

Spear also suggests, drivers not be distracted so cell phones should be put away. They need to focus on driving because there should be much more traffic. If you have small children they should be in properly installed safety seats appropriate for their size and that they’re secured properly. Allow plenty of time so there’s no need to speed and give others the benefit of the doubt so you won’t get upset at other drivers.

“If you get there 30 minutes later it’s okay. You’re going to have just as good of a time and enjoy yourself so don’t be in such a hurry to get where you’re going. Be alert and exercise extreme caution at all times,” Spear says.

Making the holiday far more hazardous are those driving under the influence of alcohol or drugs. “In Pennsylvania in 2015 there were more than 10,000 DUI related crashes with about 345 involving fatalities. It really is a very serious problem and we all need to be aware of it and act responsibly,” Spear says. He warns drivers that there will be increased DUI checkpoints over the holidays.

He says that kind of very public law enforcement can reduce the number of drunk drivers on the roads. “Even if you just save one life it’s definitely worthwhile but here you’re potentially saving many lives. If they’re out and the public sees that they’re out in force people will drive more carefully,” Spear says. “Nobody needs to drink and drive with all the resources out there like taxis, Uber and Lyft that can help you go home or get anywhere you want relatively cheaply.”

Labor Day Weekend is one of the most dangerous holidays when it comes to traffic accidents. Because he was operating his vehicle under the influence of alcohol he was distracted and in a hurry. My client ended up suffering significant injuries and had to be hospitalized all because of a flat tire and a drunk driver,” Osborne says.

He has suggestions to motorists to try to be safe this weekend. “Don’t drink and drive. Please stay off the roadways if you decide to have a few cocktails. With all the available resources today between Uber, Lyft and taxis use these services if you are out celebrating. Wear your seatbelt and be sure to not be distracted while driving,” Osborne says.

He warns that drunk driving not only can take a physical toll due to injuries but also creates legal issues if it results in an arrest. “Here in Florida and nationally the ‘Drive Sober or Get Pulled Over’ programs are in place. The Boca Raton Police Department and the Palm Beach County Sheriff’s Office are actively engaged with this program. If you see anybody you believe is impaired while driving, whether it’s on the highway or a local road, call 911 and report it to local authorities.”

Transformance Inc., a Dallas-based nonprofit dedicated to creating an integrated services delivery model for economic empowerment, has received funding from the South Dallas Fair Park Trust Fund Board. At the board’s 2016-2017 annual reception held on Thursday, Aug. 25 at the Discovery Garden at Fair Park, CEO Ken Goodgames accepted the endowment and praised the occasion.
“We’re absolutely honored and humbled to be counted among the grant recipients chosen by the South Dallas Fair Park Trust Fund Board,” stated Goodgames. “We worked hard putting together our funding request and this grant will allow Transformance to continue our outreach of providing financial coaching and other integrated services to Fair Park’s communities.”
The mission of the South Dallas Fair Park Trust Fund is to empower the Fair Park community by working to facilitate economic, housing, community advancement, business development, and community service programs. Last Thursday’s event included a full reception, speeches and check presentations. Opening remarks were given by Fair Park Trust Fund Board Chairman Maurice Franklin. Closing remarks were provided by Franklin, vice-chair Byron Lattimore, and director of the board’s office of economic development, Karl Zavitkovsky.
In total, the South Dallas Fair Park Trust Fund awarded over $750,000 in funding to 19 different nonprofit organizations for the 2016-2017 calendar year.
Transformance will use their funds to expand the outreach of Pocket Change Kids, their gamified financial education and learning platform designed to teach the basics of saving and other financial literacy lessons to grades K-5.

Until a few weeks ago, Texas drivers could refuse to consent to a blood or breath test in connection with a DWI arrest, says Dallas DWI lawyer John Helms, except that refusal would usually result in loss of driving privileges under Texas’ implied consent law. If you refused to consent, the police would have to get a search warrant to take your blood.

A new decision by the United States Supreme Court changes the landscape, though. In Birchfield vs. North Dakota, the Supreme Court held that the police still need a search warrant before they can take your blood over your objection. The Court held that the same is NOT true for breath tests, which are less intrusive because they don’t involve sticking a needle in your arm and drawing blood from your body.

For breath tests, the Supreme Court said that the police can demand a breath test as part of a DWI arrest without a warrant complicating drunk driving defense. The Court also said that states could make it a crime to refuse to give a breath test, which some states have done, including North Dakota in that particular case.

Texas does not currently make it a crime to refuse a breath test, although as noted earlier, a refusal usually means you lose driving privileges. And as noted above, if you refuse, the police can try to get a warrant to force you to provide a blood sample. But after the Birchfield decision, it would not be surprising if the Texas Legislature passes legislation making it a crime to refuse a breath test.

Dallas Criminal Lawyer On How The OJ Simpson Defense Tactics Can Help Your Case

The OJ Simpson trial happened over twenty years ago, but it continues to capture the public’s imagination. FX recently aired a miniseries on the case, and ESPN aired a five-part documentary in June about the rise and fall of OJ Simpson, added Dallas criminal lawyer John Helms.

“I was a young lawyer during the trial, and I had a case in a nearby federal court in Los Angeles. I was working very long hours at the time, but I followed the case as closely as I could.  I also read two books about the case in the years following the trial.”

So much has been written about the case, the evidence, and especially the trial, but this is my take on the main lesson a criminal defense lawyer can learn from the defense strategy: Know your jury and what will appeal to them.

The case should have been a slam-dunk for the prosecutors, and they thought it was. The evidence of Mr. Simpson’s guilt was truly overwhelming. The prosecutors failed in a lot of ways, but their main failing, in my view, was making the case too complicated without explaining how the evidence completely ruled out the defense’s theory.

What criminal defense attorney Johnny Cochran knew was that this particular jury would be receptive to a beyond-far-fetched theory that all of the evidence could have been planted by rogue, racist LAPD cops. He knew, from years of experience trying civil rights cases against the police, that the African-American community in Los Angeles had deep-seated mistrust and anger toward the LAPD, much, if not all of which was probably justified.

The jury consisted of eight African Americans, two Hispanics, one half-Native American and half Anglo, and one Anglo woman. Only two of the twelve jurors were college graduates.  None of them said they regularly read a newspaper, but eight regularly watched tabloid TV. This was, in other words, a jury that would be receptive to appeals to emotion and conspiracy theories and would likely believe that the LAPD was racist and willing to plant evidence to get a conviction just because the defendant was African American.

Johnny Cochran tried the case masterfully for this audience. He did not try to connect the dots. He used a simple argument: The cops, especially Mark Fuhrman, were racist and could not be trusted. If they were racists who could not be trusted, then all of the evidence could have been planted or doctored.

With this jury, it worked to perfection, even though it defied logic and common sense when you consider the facts. First of all, at the time the evidence was collected, the LAPD did not know whether Mr. Simpson had an airtight alibi. If he had, it would have become obvious very quickly that evidence was planted, especially Simpson’s blood at Nicole Brown’s house and cops would have gone to jail. There was also simply no way that one, or even three, police officers could have gone back and forth between Simpson’s house and Nicole Brown’s house dropping blood and evidence from one location at the other. Even if they could have, physically, the media and other officers would have seen them. There is also no innocent way to explain how Ron Goldman’s blood got in OJ Simpson’s Bronco, especially since they did not even know each other. The type of conspiracy that the defense needed would have had to involve dozens of detectives and officers, none of who knew at the time whether Mr. Simpson had an alibi. It strains logic way past the breaking point.

The prosecutors completely failed to make this point effectively. Even if they had, it is unclear that this jury would have been persuaded.

Johnny Cochran, however, knew that this jury would be persuaded less by logic and reasoning than by appeals to emotion and their pre-existing beliefs about justice and the LAPD. He wove his argument throughout the case in a simple and persuasive way.

None of this is a criticism of Mr. Cochran. He deserves the highest praise for the job he did representing his client.

The lesson of knowing your jury and what appeals to them does not just apply to high profile cases. I know from my experience trying cases that a jury in a small town in East Texas is more likely to be receptive to themes about personal liberty and personal responsibility than a Dallas jury, which may respond more to themes about fairness and equality. Each case is different, but one of a criminal defense lawyer’s most important jobs at trial is to find a theme that fits the defense and resonates with the particular jury in the box.
